I would like some feed back or direction I can go in regards to a small claim against me – i’m in bc so it is bc small claims.
Today I received a notice of claim from bc small claims court saying I owe 11xxx.xx to the other party and asks me to reply.
I did my search and found out that I can reply and I must reply within certain period (14days – correct me if I am wrong).
The story is that I looked at a house with my real estate agent but I was not really interested in the house.
However, he sort of convinced me that the price was a good deal – I still did not do anything at this point. Real estate agent suggested that he will submit an offer letter to hold the deal so if I change my mind in the next three days, I should let him know.
I told him I’m not interested – turns out agent submitted an offer letter with a cheque with an deposit amount that had my signature on it (he had a photocopy of a cheque on his file from previous deal I pursued). I did not sign the offer letter, but it was on that letter written by the agent. I am quite upset that the claim is being made against me when I did not want to pursue the purchase and did not sign or agree this letter to be sent but the other party believes I had an intent on purchasing.
What should I do in this case?
